These are the practical bits that keep things running smoothly - privacy, copyright, and how my work can be used. Nothing heavy, just the essentials.

TERMS & CONDITIONS

Sole Trader Artist & Graphic Designer (UK, 2026)

1. About Me

I operate as a sole trader under the name UNEARTHED, providing art, private commission artworks, graphic design, illustration, branding, and related creative services.

2. Definitions

“Client” means the individual or business commissioning work.

“Services” means any creative, art, design, illustration, branding, or consultancy work provided.

“Project” means the agreed scope of work as outlined in a written quote, proposal, or email confirmation.

“Deliverables” means the final files or artwork supplied to the Client.


3. Scope of Work

A written quote or proposal will outline:

  • The services to be provided.

  • The deliverables.

  • The timeline.

  • The fees and the total cost of the specific project.

Work begins once the Client confirms acceptance in writing (email is sufficient).


4. Fees & Payment

  • All quotes are valid for 30 days.

  • A standard 20% deposit may be required prior to commencing work.

  • Final payment is due within 30 days of invoice unless otherwise agreed.

  • Late payments may incur statutory interest in line with the Late Payment of Commercial Debts (Interest) Act 1998 at the Bank of England's base rate of 8%.

  • Additional work outside the agreed scope will be charged at £25/hour or quoted separately.


5. Client Responsibilities

The Client agrees to:

  • Provide clear instructions, content, and feedback.

  • Supply all required materials and requests, including confirmation of the quote within 30 days or the agreed start of the project.

  • Ensure they have the rights to any content they provide.

Delays in receiving information may extend the project timeline.


6. Revisions

Unless otherwise stated:

  • Projects include 2 rounds of revisions.

  • Additional revisions are charged at the standard hourly rate of £25/hour.


7. Intellectual Property

Please note: I retain full copyright in all creative work until the invoice is paid in full.

Upon full payment, the Client receives a licence to use the final deliverables for the agreed purpose.

This licence does not include:

  • resale

  • redistribution

  • modification by third parties

  • use outside the agreed scope unless explicitly agreed in writing.

I retain the right to display completed work in my portfolio, website, and social media unless the Client requests confidentiality in writing.


8. Use of AI Tools

If AI-assisted tools are used in the creative process, I will ensure:

  1. All outputs are original or appropriately licensed.

  2. No confidential Client data is entered into unsecure systems.

Clients may request a fully non-AI workflow if preferred.


9. Timelines & Delivery

I will make all reasonable efforts to meet agreed deadlines.

However, I am not liable for delays caused by:

  • Late Client feedback.

  • Technical issues outside my control.

  • Illness or unforeseen circumstances

Deliverables are supplied in standard digital formats (e.g., MP3, MP4, PNG, JPG, PDF, SVG).

Analogue deliverables are supplied with an Artist Certification of Authenticity (for insurance purposes and proof of ownership), and can be supplied with a digital format of a UHD JPG to be used in accordance with Section 7.


10. Cancellations & Refunds

If the Client cancels the project:

  • The deposit is non-refundable.

  • Any work completed up to the cancellation date will be invoiced.

If I must cancel due to unforeseen circumstances, the Client will receive a refund for any work not yet completed.


11. Confidentiality

Both parties agree to keep confidential any sensitive information shared during the project, except where disclosure is required by law.


12. Data Protection

I comply with UK GDPR requirements regarding the handling of personal data.

Client information is used solely for project communication, invoicing, and record-keeping.

If, at any point, you wish for any of your personal data (name, contact telephone number, email address) to be removed from my records, please notify me via the contact details in Section 1.


13. Liability

I am not liable for:

  • Indirect or consequential losses.

  • Loss of profits, revenue, or business.

  • Errors in content supplied by the Client.

My total liability is limited to the amount paid for the project.


14. Complaints

Any concerns should be raised in writing within 14 days of receiving the final deliverables.

I will work with the Client to resolve issues promptly and professionally.

If you have any concerns whilst the project is live, please email me directly, and I will respond within 24 hours.


15. Governing Law

The laws of England and Wales govern these Terms & Conditions, and any disputes will be subject to the exclusive jurisdiction of the English courts.

COPYRIGHT & LICENSING

Copyright & Licensing: How It Works

1. Copyright

As the creator, I automatically own the copyright to all artwork, designs, and creative materials I produce. This is standard under UK copyright law.


2. What You Receive

Once the project is paid in full, you receive a licence to use the final deliverables for the purpose we agreed (e.g., branding, marketing, print, social media).


3. What the Licence Covers

A standard licence includes:

  • Use of the final artwork for the agreed purpose.

  • Use across agreed platforms (e.g., web, print, packaging).


4. What the Licence Does Not Include

Unless we agree otherwise, the licence does not include:

  • Reselling the artwork.

  • Allowing third parties to modify it.

  • Using it for new or unrelated projects.

  • Transferring the licence to another business.


5. Editable Files

Editable source files are not included unless agreed in advance. These can be licensed for an additional fee, which must be confirmed and agreed in advance at the start of the contracted project.


6. Portfolio Use

I may display completed work in my portfolio or on social media unless you specifically request confidentiality.

PRIVACY POLICY

1. Introduction

I am committed to protecting your personal data. 

This Privacy Policy explains how I collect, use, and store your information.


2. Information I Collect

I may collect:

  • Your name and contact details.

  • Project information.

  • Emails and messages you send.


3. How I Use Your Information

I use your information to:

  • Communicate about projects.

  • Provide quotes and invoices.

  • Deliver creative services.

  • Maintain business records.


4. Legal Basis

I process personal data under:

  • Contract (to provide services).

  • Legitimate interests (business administration).

  • Consent (for optional marketing, if used).


5. Data Sharing

I do not sell your data. 

I do not store your data off-site, or anywhere else outside the scope of the contract or project.

I may share information with:

  • Payment processors.

  • Cloud storage providers.

  • Legal bodies, or on occasions where it is required by law.

For the purpose of the project or the contract only.


6. Data Retention

I keep project and invoice records for up to 6 years for tax purposes.


7. Your Rights

You have the right to:

  • Access your data.

  • Request corrections.

  • Request deletion (where applicable),

  • Object to certain processing.

  • Withdraw consent (if applicable).

You have full rights to the entirety of your data under GDPR Law
